ZUMEN Corporation (hereinafter referred to as the "Company") is engaged in human resource matching business centered on crowdsourcing through its online service, BIMsearch (hereinafter referred to as the "Service"), and recognizes that the protection of personal information is an important social mission and responsibility of a company. Therefore, we have established this Privacy Policy, as follows, as the basic items to be observed in order to appropriately manage the personal information of our customers held by our company. In addition, we intend to establish a personal information protection management system to realize the following policy, and the entire company will be committed to its implementation.

1. We will acquire, use, and provide personal information in an appropriate manner, and will not handle personal information beyond the scope necessary to achieve the specified purposes of use. We will also take measures to this end.

2. We will comply with laws, regulations, and rules officially established, such as guidelines set up by governments or local authorities, regarding the handling of personal information.

3. We will implement reasonable security, preventive, and corrective measures to prevent the risk of leakage, loss, or damage of personal information by taking reasonable security measures.

4. We will respond promptly and sincerely to complaints and consultations regarding the handling of personal information.

This Privacy Policy also explains how we process "personal data" about people in the European Union as required by the General Data Protection Regulation (GDPR).

We review this policy periodically and may update it from time to time.

Handling of Personal Information

1. Personal information

Personal information obtained by the Company through the Service means the following information pertaining to the identification of individuals.

  • Basic information - Information that can identify a specific individual (including information that can be matched with other information to identify a specific individual), such as address, name, telephone number, e-mail address, credit card information, login ID, password, nickname, and photograph, etc.

  • Metadata - IP address, computer and connection information, referring web page, standard web log information, language preference, time zone, etc.

  • Device information - device identifier, device type, device plug-ins, hardware features, etc.

  • Location - GPS location.

  • Information related to the content and history of your use of the Services operated and provided by the Company, including the specific content of Services provided by the Company, the content of messages, the date and time of use of the Services, and the number of times you have used the Services (pages viewed, buttons clicked, time spent viewing, search terms, etc.).

2. Acquisition and collection of personal information

We will acquire personal information in the following ways;

  • Methods of acquisition and collection through the Service
    We will obtain and collect personal information that you voluntarily provide on the website of the Service.

  • Methods of acquisition and collection by e-mail, postal service, document, telephone, etc.
    We collect personal information that you provide to us by e-mail, postal service, in writing, by telephone, or by other means.

  • Methods of collection through your access to the Company, etc.
    We will collect information such as your history of using the Service. This information includes the URL, the type of browser and cell phone, the IP address, and other information.

3. Purpose of acquisition and use of personal information

We will acquire and use personal information in a lawful and fair manner for the following purposes. We will not use the acquired personal information beyond the scope necessary to achieve the following purposes, except with the consent of the customer himself/herself.

k. For other purposes agreed upon between the Company and the customer.

5. Management of personal information

The Company shall take necessary measures to prevent loss, damage, leakage, or unauthorized use of personal information, and to safely manage such information by appointing a personal information protection manager. We will also make every effort to keep personal information accurate and up-to-date within the scope of the purposes of use.

6. outsourcing of personal information handling

In order to achieve the purpose of use of acquired personal information, we may entrust the handling of such information to a third party. In such cases, we will select a party that is deemed to be handling personal information properly, obligate the party to take necessary measures to protect personal information by concluding a contract, etc., and supervise the party appropriately.

7. Provision and disclosure of personal information to third parties

When we provide personal information to a third party, we will obtain the prior consent of the customer. However, this does not apply in any of the following cases;

I. When it is clear that the provision of personal information is particularly necessary for the protection of human life, physical health, or other serious interests, and when it is difficult to obtain the consent of the customer for the provision of personal information to a third party.

II. When we receive a request for disclosure from a court of law, the police, or other public agency with legal authority to investigate, or a person entrusted by such an agency.

III. In other cases where we are legally obligated to provide or disclose personal information in accordance with relevant laws or regulations (applicable in relation to the customer in question) concerning the protection and disclosure of personal information.

Notwithstanding the provisions of this paragraph, a person who receives such personal information from us shall not be considered a third party in the following cases

a. When we outsource all or part of the handling of personal information within the scope necessary to achieve the purpose of use

b. When personal information is provided as a result of the succession of the Company's business due to a merger or other reasons

c. In cases where we share personal information as described in "4. Joint Use of Personal Information", or in cases where we otherwise share personal information and where we have notified in advance or made readily accessible to the individual the items of personal information to be shared, the scope of users sharing the personal information, the purpose of use by such users, and the name and the address of the person responsible for managing such personal information, the name of the representative.

8. Disclosure, correction and suspension of use of personal information

When a customer requests notification of the purpose of use, disclosure, correction, addition, deletion, or cessation of use of personal information, or disclosure of records of provision to third parties, we will handle such a request appropriately. However, this does not apply in cases where we are not obligated to do so due to laws and regulations related to the protection and disclosure of personal information (those applicable in relation to the customer in question).

9. Acquisition and use of data related to personal information

When we receive information from a third party, which is not included in “personal information” defined in “1” above, and acquire such information as personal data, we will do so only after obtaining the consent of the customer, unless the third party has obtained the consent of the customer in advance to provide the information as personal data. In cases where we provide such information to a third party and the third party is expected to acquire the information provided by us as personal data, except in cases where we have obtained the prior consent of the customer to provide the information as personal data, we will only acquire the information after the prior consent of the customer is obtained by the third party. In such cases, we will provide the information only after confirming that the consent of the customer has been obtained in advance. However, this does not apply to cases where the provision of personal information is required by law, or where the provision of personal information is particularly necessary for the protection of human life, physical health, or other serious interests.

10. Cookies

We may send cookies to the customer’s computer through the Service. Cookies are a mechanism that stores the usage history of a website, input contents, etc. in a file on the customer's computer. We may link the collected behavioral history with your personal information, provided that the customer gives permission to send and receive cookies on browsers. We use cookies to improve the convenience of our services and to obtain and analyze statistical data. In addition, we use the advertising services of third-party companies to deliver the most appropriate advertisements. Cookies used by such services do not contain any information that identifies individuals, and are used only for the purpose of effective advertisement delivery and access analysis for advertisement delivery, and are not used for any other purposes. To confirm the details of the use of behavioral history information by third-party companies and to opt-out (disable) cookies sent by third-party companies, please visit the page of each third-party company.

11. Voluntary nature of providing personal information

Whether or not you provide us with personal information is at your discretion. However, if you do not provide us with the required information, we may not be able to provide you with the Service in an appropriate manner.

12. Complaint handling

We will respond to complaints regarding personal information in good faith. Any comments, questions, complaints, or other inquiries regarding the handling of personal information should be submitted to our contact point.

13. Customer’s choices and rights

You may have certain choices and rights related to your personal information. You can request that the Company respects these rights thorough our contact point.

I. For individuals residing in the European Economic Area (EEA), United Kingdom (UK), or Switzerland:.

You have a number of rights with respect to your personal information under applicable data protection laws. Under certain circumstances, you have the following rights;

  • By submitting a request to us, you will have access to your personal information.

  • You can request deleting your personal information.

  • If your personal information is incorrect, you can request us to correct it.

  • You can request the restriction of processing of your personal information; and

  • You can oppose any further processing of your personal information, including opposing marketing from us.

  • You can request data portability.

  • You can withdraw the consent you have provided to us.

  • You can request the restriction of automatic processing of personal information.

  • Tou can file a complaint to the appropriate supervisory authority.

For purposes of the GDPR, our privacy officer also serves as our data protection Officer (DPO). While we will endeavor to resolve complaints promptly and informally, if you wish to pursue a formal privacy complaint procedure, we ask that you submit your complaint in writing to our privacy officer to the email address listed in “14” below.

II. Notice for California Residents

"Shine the Light" and "Eraser" Laws: California residents may request a list of all third parties to whom we have disclosed certain information during the previous year for the purpose of third party direct marketing.

California Consumer Privacy Act (CCPA)/ California Privacy Rights Act (CPRA): The CCPA, as amended by the CPRA, gives California residents and/or their authorized agents certain rights regarding the collection and storage of personal information.

Your Right to Know: California residents have the right to request that we disclose the following information regarding our collection and use of your personal information during the past 12 months. We may ask you to provide certain information that identifies you so that we can compare that information with our records to verify your request. Upon the verification, we will disclose the following;

a. Categories of personal information we have collected about you.

b. The categories of sources of personal information we have collected about you.

c. Certain personal information that we have collected about you.

d. Our business or commercial purposes for collecting or selling your personal information.

e. The categories of third parties (if any) to whom we have sold or shared your personal information and the categories of personal information we have shared with each third party recipient.

Right to Opt-Out of Sale or Sharing of Personal Information: California residents have the right to opt-out of the sale of their personal information by contacting us thorough our contact point described in “14” below.

Please note that we do not knowingly sell the personal information of individuals under the age of 18.

If we share your personal information with third parties for the purpose of cross-context behavioral advertising or profiling, you may opt-out of such sharing at any time by contacting us thorough our contact point described in “14” below.

Right to Restrict Use of Confidential Personal Information: California residents have the right to request that we limit our use of your confidential personal information to uses necessary to perform services or other business purposes specifically enumerated under the CCPA, amended by CPRA.

Your Right to Remove: California residents have the right, with certain exceptions, to request that we delete personal information collected from you and maintained by us. We may ask you to provide certain information that identifies you so that we can compare that information with our records to verify your request. If we determine that your request has been verified and that we need to delete the requested personal information in accordance with the CCPA, we will delete your personal information from our records and direct our third party service providers to do so. Under one or more of the exceptions described in the CCPA, if we determine that we need to retain such personal information based on one or more of the exceptions listed in the CCPA, your request to delete the personal information we have collected may be denied.

Your Right To Correction: Pursuant to the CCPA, as amended by the CPRA, California residents have the right to request that we correct any inaccurate personal information we maintain about you, taking into account the nature of the personal information and our purposes for processing such personal information. We will use commercially reasonable efforts to correct any such inaccurate personal information we maintain about you.

Non-Discrimination: We do not discriminate in any way with respect to the exercise of privacy rights granted by the CCPA.

Request Verification: Only you, or someone authorized to act on your behalf, may make requests related to your personal information. In the case of access and deletion, a request must be verifiable before we can respond to such a request. To verify your request, you must provide us with sufficient information to reasonably verify that you are the person whose personal information we have collected or authorized to act on your behalf. We use the personal information you provide in a verifiable request only to verify your request. If we cannot verify your identity or authority, we will not be able to comply with your request or provide you with personal information. Please note that if your request is excessive, repetitive, or manifestly unfounded, we may charge you a reasonable fee or refuse to act on your request.

III. Notice to Nevada Residents

Under Nevada law, certain Nevada residents may opt out of the sale of "personally identifiable information" to an individual for monetary consideration. “Personally identifiable information" includes names, addresses, email addresses, telephone numbers, social security numbers, or identifiers that allow someone to contact a particular individual physically or online.

We are not involved in such activities. However, if you are a Nevada resident who has purchased or leased goods or services from us, you may submit a request to opt-out of future sales by sending an email to the email address listed in the section "14" below, in accordance with Nevada law. Please be advised that we will take reasonable steps to verify your identity and the authenticity of your request. Once verified, we will maintain your request even if our practices change.

IV. Notice to Virginia Residents

The Virginia Consumer Data Protection Act ("VCDPA") gives Virginia residents certain rights, including;

  • Your Right to Know: Under the VCDPA, you can find out whether we are processing your personal information.

  • Right of Access: Under the VCDPA, you must be able to obtain a copy of the personal information we maintain or process, in a portable and, to the extent technically feasible, readily usable format.

  • Right to Delete: Under the VCDPA, you have the right to request that we delete any personal information we maintain or process.

  • Your Right To Correction: Under the VCDPA, you have the right to request that we correct any inaccuracies in your personal information that we maintain or process, taking into account the nature and purpose of such processing.

  • Your Right to Opt-Out: Under the VCDPA, you have the right to opt-out of the processing of certain types of personal information, including;

a. Opt-out of "sale" of personal information.

b. Opt-out of targeted advertising by us.

c. Opt out of the processing of personal information for purposes of making decisions that have legal or similarly important consequences.

Please note that, as explained above, we do not "sell" personal information in a traditionally defined way. However, we do share personal information with third parties in order to provide you with personalized advertising, and we may make certain personal information available to third parties through the use of cookies. This is "targeting" that you may opt-out of under Virginia law.
